GENERAL CONDITIONS OF SALE
These General Conditions of Sale define the terms and conditions for the purchase and sale of Filati Romani Collection products ("Products") displayed on the Filati Romani.com website ("Site"). Anyone browsing the Site ("User") is invited to read these General Conditions of Sale of the Contract before completing a purchase order for Products on the Site ("Order"); in fact, sending an Order implies its unconditional acceptance.
Use of the Site is subject to the Terms of Use of the Filati Romani.com website which can be consulted in the Legal Area section.
These General Conditions of Sale, together with the Order Confirmation, constitute the sales contract ("Contract") between Filati Romani S.r.l. ("Seller") and the Customer who regulates the supply of Products.
Filati Romani S.r.l. reserves the right, at any time and at its sole discretion, to modify, revise, add or remove parts of these General Conditions of Sale. Any modification to the Contract will become effective immediately upon publication on the Site and will govern all subsequent Orders.
1. Customers
The conclusion of Orders on the Site is permitted only to natural persons who have the legal capacity to enter into binding agreements in compliance with the applicable law and who act for purposes unrelated to any business or professional activity carried out ("Customers").
Where required, Customers must provide name, surname, date of birth, e-mail address, delivery address of the Orders, tax code and other personal information. Such information must be true, accurate and constantly updated.
The Customer cannot place Orders on the Site using the name or credentials of another person, unless expressly authorized by the person entitled.
The purchase of any item of clothing on the Site for resale is prohibited.
2. Orders and Acceptance
The FILATIROMANI.COM site allows the User to choose the models of clothing displayed on the Site, selecting the specific characteristics of the chosen model (size, size, color and any customizations) and to proceed with the purchase by clicking on "CONFIRM AND PAY ” (so-called “point and click”).
In this way, the Customer undertakes to purchase the chosen Product with the selected characteristics and any customizations and, consequently, to pay the relative price.
With the transmission of the Order, the Customer unconditionally accepts these General Conditions of Sale and undertakes to observe them in accordance with the provisions herein.
Following the electronic submission of an Order, the Customer will receive a specific e-mail confirming receipt of the Order.
This communication is functional to communicate to the Customer that the Order has been received but does not in any way imply acceptance of the Order by the Seller. If one or more data contained in the e-mail is not correct, the Customer must promptly notify the Seller's Customer Service through the link included in the confirmation of receipt of the Order.
Acceptance of the Order by the Seller will take place only when the latter sends the Customer the Order Acceptance Confirmation ("Order Confirmation"), usually within 7 days of receipt of the Order, following the verification of the effective availability of the materials necessary for the production of the selected garments at the partner artisans of Filati Romani S.r.l.
Upon receipt of the Order Confirmation by the Customer, the relevant Contract must be considered completed and will be binding on the Customer, subject to the exercise of the right of withdrawal under the conditions specified in article 6 below.
Before then, the Seller reserves the right not to accept an Order where it deems it appropriate. In particular, the Seller will not be responsible, in any capacity, in the event that an ordered model is removed from the Site after the relative Order has been sent. In fact, it may happen that the Site displays, by mistake, models that are not currently available.
In the event of partial unavailability of the Order, the Customer Service will contact the Customer to verify the willingness of the latter to (a) receive a partial Order, (b) the complete Order in several shipments or (c) cancel the Order .
In the event of total unavailability of the Order, however, the Customer Service will contact the Customer to inform him that the Order cannot be processed and will cancel the relative Order. In this case, no charge will be made to the Client.
At the same time as sending the Order Confirmation, the Customer will also receive the electronic invoice relating to his Order.
3. Prices and Payments
All prices published on the Site are inclusive of VAT.
